These Terms of Service (the "Terms") govern your access to and use of the online culinary education services, courses, live lessons, and related content (the "Services") provided by JCAA Limited, trading as Japan Culinary Arts Academy ("JCAA", "we", "us", or "our"), a company registered in Gibraltar under company number 126328 with its registered office at 1202 Atlantic Suites, Gibraltar GX11 1AA, Gibraltar, through this website and the Kajabi platform. By purchasing a course or using the Services, you agree to be bound by these Terms.

1. Eligibility and Account

1.1 You must be at least 18 years old to purchase and use the Services.

1.2 You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

1.3 You agree to provide accurate and complete information when registering and to keep it up to date.

2. Services

2.1 The Services consist of pre-recorded video lessons, downloadable materials, and, where specified, live online lessons relating to Japanese culinary arts.

2.2 We may update, modify, or improve the content of any course from time to time. We reserve the right to change lesson schedules for live sessions with reasonable prior notice.

2.3 Access periods (e.g., lifetime access or fixed-term access) are as stated on the relevant sales page.

3. Payment and Subscriptions

3.1 Prices are displayed on each sales page and are charged at the time of purchase through the Kajabi platform and its payment processors.

3.2 For subscription plans, your payment method will be charged automatically on each billing date until you cancel. You may cancel at any time, with cancellation taking effect at the end of the current billing period.

3.3 You are responsible for any taxes, currency conversion fees, or bank charges applicable in your jurisdiction.

4. Refund Policy

4.1 Due to the digital nature of the content, all sales are final. Except as required by applicable law, no refunds will be provided once access to the course materials has been granted.

4.2 If we cancel a live lesson and cannot offer a reasonable alternative date, you will receive a refund for that lesson.

4.3 If we are unable to deliver a purchased service for reasons attributable to us, a full refund will be issued.

5. Intellectual Property

5.1 All course content, including videos, recipes, texts, images, and materials, is the intellectual property of JCAA or its licensors and is protected by copyright and other laws.

5.2 We grant you a personal, non-exclusive, non-transferable, revocable license to access the content for your own private, non-commercial use.

5.3 You may not copy, record, download (except where a download function is provided), share, resell, publicly screen, or redistribute any content, nor share your account access with any third party. Violation of this section may result in immediate termination of access without refund and may give rise to legal claims.

6. Rules of Conduct

When participating in live lessons, comments, or community features, you agree not to:

  • Harass, abuse, or disrespect instructors or other participants
  • Post unlawful, offensive, or infringing content
  • Disrupt lessons or misuse the platform We reserve the right to remove content and suspend or terminate access for violations of these rules.

7. Health, Safety, and Cooking Disclaimer

7.1 Our lessons involve cooking techniques that may include the use of knives, heat, and raw ingredients (including raw fish). You participate in and replicate any techniques entirely at your own risk and are responsible for your own safety and hygiene practices.

7.2 You are solely responsible for verifying that ingredients are safe for your own consumption, including with respect to allergies, dietary restrictions, and local food safety standards. Recipes and information provided in the Services do not constitute medical, nutritional, or food-safety advice.

7.3 If you are handling raw fish or other high-risk ingredients, you should follow the food safety guidelines applicable in your country.

8. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services will be uninterrupted, error-free, or that any particular skill level or result will be achieved.

9. Limitation of Liability

To the fullest extent permitted by applicable law, JCAA shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising out of or in connection with your use of the Services. Our total aggregate liability for any claim arising from the Services shall not exceed the amount you paid to us for the relevant course in the twelve (12) months preceding the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

10. Termination

10.1 You may stop using the Services at any time.

10.2 We may suspend or terminate your access if you materially breach these Terms, including the intellectual property and conduct provisions, without refund.

11. Changes to the Terms

We may revise these Terms from time to time. The updated Terms will be posted on this page with a revised "Last updated" date. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Gibraltar. Any dispute arising out of or in connection with these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Gibraltar, except where mandatory consumer protection laws of your country of residence provide otherwise.
